IIHF Ticketbedingungen der DEB Eishockey-Sportgesellschaft mbH zur 2017 IIHF Eishockey-Weltmeisterschaft

Der Ticketkäufer stimmt den unten stehenden Bedingungen zu und verpflichtet sich, diese einzuhalten. Sofern er Tickets erwirbt und diese an Dritte weitergibt, so steht er dafür ein, dass auch der Dritte sich diesen Bestimmungen unterwirft und diese einhält. 

1. Die Nutzung der Tickets (Tickets) für Spiele der 2017 IIHF Eishockey-Weltmeisterschaft (Veranstaltung) und der Einlass ins Stadion erfolgen vorbehaltlich der folgenden Bedingungen (Bedingungen) und aller anderen Vorschriften (Vorschriften), die die IIHF, das lokale Organisationskomitee, die Ticket-Verkaufsstelle und/oder der Stadioneigentümer/-betreiber (gemeinsam die maßgeblichen Stellen) erlassen. Jede Person, die Tickets erwirbt oder nutzt, akzeptiert mit diesem Erwerb oder der Nutzung die Bestimmungen der vorliegenden Bedingungen und Vorschriften.

2. Das Ticket stellt eine widerrufliche Lizenz dar. Vorbehaltlich weiterer rechtlicher Schritte haben die maßgeblichen Stellen das Recht, Tickets ohne Erstattung des Ticketpreises zu stornieren und/oder die Rückgabe der Tickets zu verlangen und/oder den Zutritt zum Stadion zu untersagen oder eine Person desselben zu verweisen, wenn die Person gegen die Bedingungen oder Vorschriften verstößt.

3. Es ist Besuchern der Veranstaltung grundsätzlich untersagt, Ton- oder Bildaufnahmen oder Beschreibungen oder Ergebnisse der Veranstaltung zu kommerziellen Zwecken oder anderweitig ganz oder teilweise aufzunehmen und zu übertragen oder anderweitig über das Internet oder sonstige Medien zu verbreiten oder Dritte dabei zu unterstützen. Es ist untersagt, Geräte, die hauptsächlich zu den oben genannten Zwecken gedacht sind, in ein Stadion, in dem ein Spiel der Veranstaltung stattfindet, mitzunehmen (ausgenommen Mobiltelefone, sofern das Mobiltelefon ausschließlich für die Durchführung und Entgegennahme persönlicher Anrufe benutzt wird).

4. Tickets dürfen ohne vorherige schriftliche Genehmigung der IIHF nicht zu Werbe-, Verkaufsförderungs- und sonstigen kommerziellen Zwecken verwendet werden (einschließlich, aber nicht beschränkt auf Angebote zum Kauf, Nutzung als Prämie, Werbegeschenk oder Preis in einem Preisausschreiben oder einem Gewinnspiel). Insbesondere ist der gewerbliche Weiterverkauf von Tickets nicht gestattet.

5. Aus Sicherheitsgründen und zur störungsfreien Durchführung der Veranstaltung müssen sich alle Personen auf Aufforderung der maßgeblichen Stellen ausweisen und die Prüfung ihrer persönlichen Gegenstände, die sie bei sich führen, die Beschlagnahmung verbotener Gegenstände und/oder Leibesvisitationen zulassen.

6. Es ist untersagt, beim Betreten eines Stadions, in dem ein Spiel der Veranstaltung stattfindet, Werbe- oder Verkaufsförderungsmaterial jedweder Art mitzuführen, einschließlich, aber nicht beschränkt auf Banner, Schilder, Handzettel, Werbegeschenke, Symbole oder Broschüren. Die maßgeblichen Stellen behalten sich vor, solche Gegenstände am Eingang zu beschlagnahmen. Weiterhin ist es untersagt, Gegenstände mit in das Stadion zu nehmen, die störende Geräusche erzeugen, einschließlich, aber nicht beschränkt auf Drucklufthörner, Vuvuzelas und Megafone. Die maßgeblichen Stellen behalten sich vor, solche Gegenstände am Eingang oder im Stadion zu beschlagnahmen. Personen, die sich an einem Veranstaltungsort befinden (einschließlich des unmittelbaren Umfelds des Stadions), ist es untersagt, sog. Ambush-Marketing durchzuführen, kommerzielle oder beleidigende Schilder zu zeigen, Waren oder Dienstleistungen zu verkaufen, Gegenstände oder Kleidung zu tragen, die politische Botschaften kommunizieren oder der Werbung oder Verkaufsförderung dienen oder solche zu verteilen oder Aktivitäten jedweder Art durchzuführen, die die maßgeblichen Stellen als gefährlich oder anderweitig unangemessen erachten.

7. Die Ticketinhaber stimmen dem Folgenden zu: (a) Anfertigung von Bild- und/oder Tonaufnahmen ihrer Person mit jedweder Technologie (einschließlich, aber nicht beschränkt auf Bild- und Tonaufnahmen durch Fernsehkameras und Fotografen) und (b) die kostenlose und weltweite kommerzielle und/oder nicht-kommerzielle Nutzung von Ton- und Bildaufnahmen ihrer Person.

8. Die maßgeblichen Stellen schließen jede Haftung aus, einschließlich, aber nicht beschränkt auf indirekte oder Folgeverluste oder -schäden, entgangenen Genuss oder Reise- oder Übernachtungskosten. Die maßgeblichen Stellen schließen hiermit im gesetzlich möglichen Umfang jegliche Haftung für Verluste und Personen- und Sachschäden aus, die am oder um den Veranstaltungsort entstanden sind. Die maßgeblichen Stellen garantieren keine freie und ungestörte Sicht auf die Spiele.

9. Der Ticketinhaber verpflichtet sich, im Zusammenhang mit Streitigkeiten bezüglich der Nutzung eines Tickets oder des Besuchs der Veranstaltung diese Streitigkeit einvernehmlich mit den maßgeblichen Stellen beizulegen und, sollte diese einvernehmliche Beilegung nicht gelingen, die Streitigkeit ausschließlich zuständigen Gerichten in Deutschland vorzulegen, wobei die Streitbeilegung Deutschem Recht unterliegt.

IIHF Ticketbedingungen von FRANCE HOCKEY PARIS 2017

Die Person, für die ein Ticket ausgestellt wurde, verpflichtet sich, die nachfolgend genannten Bedingungen zu akzeptieren und einzuhalten: 

1. Jegliche Verwendung der Tickets (Tickets) für ein Spiel der Eishockeyweltmeisterschaft IIHF 2017 (Veranstaltung) und der Zugang zum Stadion unterliegen den folgenden Bedingungen (Bedingungen) sowie jeglicher anderen Festlegung (Festlegung) , die von dem IIHF, dem lokalen Spielorganisationsausschuss, dem Ticketing Service und/oder dem Stadionbetreiber (allgemein bezeichnet als die Befugten vorgeschrieben sein kann. Es wird davon ausgegangen, dass derjenige, der Tickets erwirbt oder nutzt, die Bestimmungen der Bedingungen und Festlegungen akzeptiert. 

2. Das Ticket stellt ein widerrufliches Nutzungsrecht dar. Neben anderen Rechtsmitteln haben die Befugten das Recht, ohne jegliche Rückerstattung, Tickets zu stornieren und/oder die Rückgabe zu verlangen und/oder den Zugang zu verweigern oder eine Person des Stadions zu verweisen, wenn sie diese Bedingungen und Festlegungen verletzt.

3. Jegliche Person, die an der Veranstaltung teilnimmt, darf im Internet oder jeglichem anderen Medium kein Bild oder keine Beschreibung oder kein Ergebnis der Veranstaltung für eine kommerzielle oder anderweitige Nutzung ganz oder teilweise eintragen, übermitteln oder irgendwie verbreiten oder irgendeiner anderen Person/irgendwelchen anderen Personen helfen, diese Tätigkeiten auszuüben. Es ist verboten, in ein Stadion, in dem ein Spiel der Veranstaltung stattfindet, irgendeine Ausrüstung oder hergestellte Vorrichtung mitzubringen, deren wesentliche Eigenschaften für eine der o.g. Tätigkeiten verwendet werden können (mit Ausnahme von Mobiltelefonen unter der Bedingung, dass das Telefon in gutem Glauben nur verwendet wird, um Anrufe zu tätigen/zu empfangen). 

4. Die Tickets dürfen ohne die vorherige schriftliche Genehmigung vom IIHF nicht für Werbe- und Promotionszwecke oder andere kommerzielle Ziele verwendet werden (einschließlich - und ohne Anspruch auf Vollständigkeit – für Verkaufsangebote, die Verwendung als Prämie, Geschenk oder Preis in einem Wettbewerb oder einer Lotterie).

5. Wenn die Befugten aus Sicherheitsgründen und Gründen des geordneten Ablaufs und ohne die Veranstaltung zu stören es verlangen, muss jede Person bei der Kontrolle ihrer Identität, der Kontrolle ihrer persönlichen Gegenstände und der Beschlagnahmung von verbotenen Gegenstanden und/oder den Körperkontrollen kooperieren. 

6. Es ist verboten, in das Stadion, indem ein Spiel der Veranstaltung stattfindet, irgendwelche Promotions- oder kommerzielle Gegenstände jeglicher Art einschließlich - und ohne Anspruch auf Vollständigkeit - Banner, Transparente, Prospekte, Geschenke, Symbole und Flugblätter mitzubringen. Die Befugten behalten sich das Recht vor, derartige Gegenstände am Eingang zu beschlagnahmen. Zudem ist es verboten, in das Stadion jegliche Art von künstlichen Quellen für störenden Lärm einschließlich - und ohne Anspruch auf Vollständigkeit - Hupen, Vuvuzuelas und Megaphone mitzubringen. Die Befugten behalten sich das Recht vor, derartige Gegenstände am Eingang zu beschlagnahmen. Es ist jeglicher Person, die sich auf dem Spielgelände (einschließlich des Bereichs in unmittelbarer Umgebung des Stadions) befindet, verboten, „Ambush-Marketing“ Aktivitäten auszuüben, Firmenplakate oder beleidigende Plakate anzubringen, Güter oder Dienstleistungen zu verkaufen, politische, Werbe- oder Promotions-Materialien zu tragen oder zu verteilen sowie irgendeine andere Tätigkeit auszuüben, die als gefährlich oder anderweitig unangemessen von den Befugten betrachtet wird. 

7. Der Inhaber der Tickets erteilt seine Zustimmung für: (a) die Aufnahme seines Bildes und/oder seiner Stimme durch jegliche Mittel (einschließlich - und ohne Anspruch auf Vollständigkeit - audiovisuelle Aufzeichnungen durch Fernsehkameras oder Fotografen); und (b) die kommerzielle Nutzung und/oder nichtkommerzielle Nutzung seines Bildes weltweit durch jegliche Mittel und ohne Entschädigung. 

8. Die Befugten übernehmen keine Haftung, gleich welcher Art, unter anderem- für jeglichen direkten oder indirekten Verlust oder Schaden, Schaden durch Inanspruchnahme oder Schaden infolge Reise- oder Unterbringungskosten. In den vom Gesetz erlaubten Grenzen schließen die Befugten jegliche Haftung für den Verlust, die Beeinträchtigung oder den Schaden, die der Person oder ihren Gütern innerhalb oder um das Stadion herum entstanden sind, aus. Die Befugten sind nicht haftbar für jegliche unterbrochene und/oder eingeschränkte Sicht auf die Spiele. 

9. Der Ticketinhaber akzeptiert, dass er bei jeglicher Streitigkeit bezüglich der Nutzung eines Tickets oder der Teilnahme an der Veranstaltung versuchen wird, eine derartige Streitigkeit einvernehmlich mit den Befugten zu lösen, und sollte dies nicht möglich sein, den Rechtsstreit ausschließlich vor französischen Gerichten unter Anwendung des französischen Rechts auszutragen.

IIHF Fantasy Game and IIHF Prediction Game
By registering to participate in the IIHF Fantasy Game (http://fantasy.iihfworlds2017.com) or IIHF Prediction Game (http://predictions.iihfworlds2017.com) (hereinafter collectively referred to as the “Game(s)”) governed by these Legal Terms and the Game(s)’ Rules (indicated on http://fantasy.iihfworlds2017.com/IIHFFantasy2017TermsandConditions.pdf) you agree to be bound by not only these Legal Terms but also the Games’ Rules.

No purchase of any item or service is necessary in order to enter the Game(s) and no payment is required from you to enter the Game(s). The sole consideration from you is that you agree to be bound by these Legal Terms and the Game(s)’ Rules.

The prize winner may be required to participate in future publicity. By participating in the IIHF Fantasy Game or IIHF Prediction Game, the prize winner and their guests agree that the IIHF can record, film and/or photograph their participating in all aspects of the relevant prize and exploit, and authorize third parties to exploit, such films, photographs or recordings in any media now known or hereafter invented in any part of the world and for any purpose whatsoever in perpetuity, with no payment being due to the competitor or their guests.

Proof of making an entry does not constitute proof of receipt by the IIHF. The IIHF does not accept any responsibility for entries which are lost, damaged, or delayed (including due to internet service disruption).

The IIHF reserves the right to suspend and delete teams that contain team names which are deemed to be inappropriate or offensive. Depending on the seriousness of the situation, the competitor’s account may be deleted in its entirety without notice. Any such decisions by the IIHF are final. In the event that a team name is deemed unsuitable, the IIHF may reject such team name and provide the competitor seven days to change the name.

Any personal information that you submit will be controlled by the IIHF Privacy Policy (available at iihf.com (IIHF Homepage). The IIHF will not disclose your personnel information to any other competitor or third parties unless required to do so by applicable law.

The IIHF does not condone competitor setting up/joining games charging for entry and cannot be held responsible for their management or any loss suffered through users’ involvement.

The IIHF Fantasy Game or IIHF Prediction Game will be governed by the Game(s) Rules. The IIHF reserves the right to alter, amend, or supplement the Game(s) Rules from time to time in its absolute discretion. You agree that no liability shall attach to the IIHF as a result of any such change and so are advised to check the Game(s) Rules regularly from time to time. The Game(s) Rules form part of these Legal Terms. The IIHF will be the sole decision-maker of any matter of interpretation of the Game(s) Rules and any aspect of the content of, or playing of, the Game(s). All IIHF decisions as to any matter arising out of or in connection with the Game(s) Rules including, but not limited to, the allocation of points to any player and/or the award of any Prize and/or ranking shall be final and conclusive.

Any breach of the Game(s) Rules from time to time will also be a breach of these Legal Terms. In the event of any breach of these Legal Terms or the Game(s) Rules, the IIHF reserves the right to refuse entry to the Game(s), disqualify you from the Game(s). If you are barred or disqualified from entry, you shall not be eligible to participate in the Game(s) under any other identity or team name (any such decision by the IIHF is final).

Intellectual property
You acknowledge and agree that: (a) all IIHF logos and marks as well as all other proprietary materials depicted on this Website (collectively referred to as “IIHF Marks”), the Services and the Content are the property of the IIHF and may not be reproduced for any reason without the prior written consent of the IIHF; and (b) the Content, including without limitation, news articles, press releases, statistics, player biographies, photographs, images, illustrations, audio and video clips, is the property of, or is licensed to the IIHF. You further acknowledge and agree; (a) any necessary software used in connection with this Website, the Services and the Content (the “Software”) contains proprietary and confidential information that is protected by applicable intellectual property and other laws and is either owned by or licensed to the IIHF; and (b) content contained in Partner advertisements or information presented to you through this Website, the Services and the Content is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IIHF EXPRESSLY DISCLAIMS ALL WARRANTIES, CONDITIONS AND OTHER TERMS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED TERM OF ACCURACY, MERCHANTIABILITY, SATISFACTORY QUALITIES, FITNESS FOR A PARTICULAR PURPOSE, AND ANY TERM AS TO THE PROVISION OF SERVICES TO A STANDARD OF REASONABLE CARE AND SKILL OR AS TO NON-INFRINGEMENT OF AN INTELLECTUAL PROPERTY RIGHT.

B) IIHF makes no warranty or representation that (i) the Website, or any feeds from it, will meet your requirements, (ii) the Website, or any feed from it, will be uninterrupted, timely secure or error-free, (iii) the results that may be obtained from the use of the Website, or any feeds from it, will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the website will meet your expectations, and (v) any errors in the software will be corrected.

C) Any material downloaded or otherwise obtained through the use of the Website, or any feeds from it, is done at your own discretion and risk and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.

D) Commentary and other materials posted on the Website, or contained in any feeds from it, are not intended to amount to advice on which reliance should be placed. No information, whether oral or written, obtained by you from IIHF or through or from the Website shall create any warranty or other obligation not expressly stated in the IIHF Legal Terms and the IIHF disclaims all liability and responsibility arising from any reliance placed on such materials by any visitor to the Website or by anyone who may be informed of any of its contents.

Limitation of Liability
You expressly acknowledge and agree that IIHF shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if IIHF has been advised of the possibility of such damages) resulting from: (a) the use or the inability to use the Website; (b) the cost of procurement of substitute services resulting from any data, information or services purchased or obtained or messages received or transactions entered into through or from the Website; (c) unauthorized access to or alternation of your transmission or data; (d) statements or conduct of any third party on the Website; (e) results of the Website, any Websites linked to it and any materials posted on it; (f) with respect to the IIHF Fantasy Game, any loss which you may suffer as a result of or in connection with or arising out of any Prize, or (g) any other matter relating to the Website.

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Website of these Legal Terms must be filed within one (1) year after such claim or cause of action arose. IF YOU DO NOT DO SO, YOU EXPRESSLY WAIVE ANY RIGHT TO HAVE TO DO SO.

Indemnity
Notwithstanding any other term of this Agreement or any act or failure to act by the IIHF or its vendors or Partners, you agree to indemnify, defend and hold harmless the IIHF and its respective officers, directors, governors, owners, other officials, partners, partnerships, principals, employees, affiliates and other related entities, servants, agents, representatives, successors and assigns from and against any claim or demand, including reasonable attorneys’ fees, arising out of (a) a Message you submit through the Website or Services; (b) your use of this Website or the Services; (b) your participation in any activities arising from the Websites; (c) your connection with the Website or the Services; (d) your violation of, or failure to perform your obligations under the Legal Terms; or (e) your violation of any rights of another.

Linking to the Website and Embedding Content
A) No link to any part of the Websites may be “framed” to the extent such frame contains any sponsorship, advertising or other commercial text or graphics. All links to the Websites must be to the applicable Website’s home page. “Deep Linking” to internal pages of the Websites is expressly prohibited.

B) Certain Services may provide you with the ability to embed Content into other websites. All use of embedded content must be for non-commercial purposes.

Pay Services
Please note that all Pay Services are provided through an independent billing partner and by subscribing to the Pay Services you will be contracting directly with the independent billing partner and not the IIHF.

You must provide the independent billing partner with valid credit card information. You are responsible for paying any amounts billed to your credit card by you or a third party, whether or not you authorized such billing.

Privacy and Security
In order to use some of the Services, you may be required to register with the IIHF by providing certain information about yourself, including your name and email address. As the IIHF is subject to Swiss Data Protection Laws when collecting and processing personal data, all information collected about you during your registration for and/or use of this Website or Services will be used in accordance with all applicable laws, including, but not limited to, Swiss Data Protection Laws, and with the IIHF.com Privacy Policy (the terms of which are hereby incorporated into these Legal Terms by reference). You agree to provide true, accurate, current and complete information about yourself as requested in connection with your registration for Services. If you provide untrue and/or inaccurate information or the IIHF has reasonable grounds to suspect the information is untrue and/or inaccurate, the IIHF has the right to suspend or terminate your registration.

Certain Services may require that you create a password upon completing the registration process for the respective Service. You are responsible for maintaining the confidentiality of the password and are fully responsible for all activities that occur under your password.

If you communicate with IIHF by e-mail, you should note that the security of Internet e-mail is uncertain. By sending sensitive or confidential e-mail messages which are not encrypted you accept the risk of such uncertainty and possible lack of confidentiality over the internet.

General Information
The Legal Terms constitute the entire Agreement between you and the IIHF in relation to their subject matter, superseding and extinguishing any prior agreements, arrangements, undertakings of any nature, between you and the IIHF, whether oral or written in relation to such subject matter.

The Legal Terms and the relationship between you and the IIHF shall be governed by the Laws of Switzerland. In the case of a dispute, you agree to submit to the exclusive jurisdiction of the courts of Zürich, Switzerland.

Any failure by the IIHF to exercise or enforce any right or provision of these Legal Terms shall not constitute a waiver of such right or provision.

If any provision of these Legal Terms is found to be invalid, the parties nevertheless agree that the parties’ intentions as reflected in the provision shall be given effect to the fullest extent practicable, and the other provisions of these Legal Terms remain in full force and effect. The section titles in these Legal Terms are only for convenience and have no legal or contractual effect.
